Forschung

Schwerpunkte

Prof. Dr. Jochen von Bernstorff, LL.M. (EUI) hat seit 2011 an der Juristischen Fakultät der Universität Tübingen die Professur für Verfassungsrecht, Völkerrecht und Menschenrechte inne. Er erhielt insgesamt vier Rufe auf Völkerrechtslehrstühle im In- und Ausland (letzter Ruf 2022 an die Humboldt-Universität zu Berlin). Als Gastprofessor unterrichtet bzw. unterrichtete er u.a. an der Université Panthéon-Assas Paris II (IHEI), der Université Aix-Marseille und der National University Taiwan. Er leitet seit 2020 den Attaché-Völkerrechtslehrgang an der Akademie Auswärtiger Dienst des Auswärtigen Amtes.

Er war von 2003 bis 2007 im Diplomatischen Dienst im Arbeitsstab für multilaterale Menschenrechtspolitik des Auswärtigen Amtes tätig und war Mitglied mehrerer deutscher Delegationen bei den Vereinten Nationen. Anschließend war er Senior Research Fellow und Pressesprecher am Max-Planck-Institut für ausländisches öffentliches Recht und Völkerrecht in Heidelberg, Visiting Fellow am Lauterpacht Centre in Cambridge und Fernand Braudel Fellow am EUI in Florenz. Er ist Mitglied des Scientific Advisory Board des European Journal of International Law und war als Berater für die Vereinten Nationen (FAO/UNEP/Weltbank), das deutsche Auswärtige Amt und den Deutschen Bundestag tätig.

Forschungsschwerpunkte sind das allgemeine Völkerrecht, Theorie und Geschichte des Völkerrechts und seiner Institutionen, mit einem aktuellen Schwerpunkt auf der Entwicklung des Gewaltverbots und des Humanitären Völkerrechts. Buchpublikationen umfassen die Monographie The Public International Law Theory of Hans Kelsen (CUP 2010) und die jüngste Monographie L'essor et la Chute du Droit International Humanitaire: Une brève Histoire de la Codification de la Protection des Civils en Temps de Guerre (Pedone Paris 2023). Zu den jüngsten Sammelbänden gehören The Battle for International Law in the Decolonization Era (OUP 2019, mit P. Dann) and Affectedness and Participation in International Institutions (Routledge 2019, mit J. Sändig und A. Hasenclever).
